Re dog: It’s a total bummer to lose a pet, but I think the driver has legal ground to stand on. Ethically, it seems a little cold to sue someone after running over their pet.

I don’t see those as the same, Aliecat. Motorists should have every right to sue people who damage their car through negligence or lawlessness. A cyclist isn’t immune to the law just because they’re physically vulnerable. If you run a red light and cause an accident, you are every bit as legally accountable as a car that does the same thing.either. I don’t see this as one of those ridiculous law suits. Incidentally, the main reason for the lawsuit was to establish that the cyclist caused the accident to protect the motorist from lawsuits going the other way.

Our cat Bertie bolts sometimes. It wouldn’t make us irresponsible pet owners if he were hit by a car, but I would sure as hell take responsibility for an accident instead of taking a sledgehammer to the hapless bastard who hit him.

In the legal sense, the owners of the dog are 100% liable for the damage done to the guy’s car.
The countersuit is ridiculous. The dog’s owners are the real assholes here, and suing for a dog’s value means it’s merely a piece of property to them, so it makes the original guy look a lot less like an asshole. Not to mention that in no way could it be construed that it’s somehow this guy’s fault their animal decided to make a run for it.
On another tangent, fuck people who buy dogs from breeders. Same goes for cats. So many animals in shelters yet you HAVE to buy the dog that supports your vanity habit.

He might have had collision-only insurance… or maybe he doesn’t want to pay the deductible and his premiums going up. Who knows? It doesn’t matter. He’s under no obligation to just suck it up and pay for the damages if he doesn’t want to.

In any case, making a claim against your insurance these days is just asking for a monumental rate increase. It’s better to go after other sources of payment first if there’s any suggestion of another party being at fault. Blame the insurance companies for that.

I love dobermans and I wanted two, so I bought them from a very small reputible breeder.
Do you know how long I’d have to wait to find one, let alone two, doberman puppies in pound?
Do you know how awesome it is to raise pets that are actual siblings?
I did get our cat from the pound and I donate to the humane society every year.
